1. Information on how to enter forms part of these conditions of entry.
2. Entry is open to Australian residents of NSW, ACT, QLD, SA and WA over the age of 18 who purchase a Lindt Dessert at any Event, Greater Union or Birch Carroll & Carroll cinema with Gold Class and complete and submit an entry form during the competition dates to automatically go into the draw to win.
3. The Promoter, other entities and agencies associated with this competition, their related bodies corporate and each of their officers, agents, employees and immediate family of any of them are ineligible to enter. “Immediate family” means spouse, parent, child or sibling, whether or not they live in the same household as the employee.
4. By entering this promotion, Eligible Participants agree to be bound by these terms and conditions. The Promoters reserve the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Conditions of Entry.
5. The competition commences at 12.01am AEST on 18/03/2010 and closes at midnight AEST on 21/04/2010 (‘Promotion Period’).
6. To enter, customers must have included in their entry their name, address, email and phone details and submit the entry form in Gold Class to a staff member.
7. No responsibility will be taken by the Promoter for any ineligible or lost entries or entries submitted or received by the Promoter after the closing date. Entries that do not comply with these terms and conditions are incomplete, or submitted or received by the Promoter after the closing date will be declared void.
8. The competition prize draw for the winner will take place at 12.00pm AEST on 22/04/2010, at the office of the Promoter, located at 49 Market Street, Sydney NSW 2000. All winners will be contacted immediately by phone and mail relying on contact details provided by the entrant. To be eligible to take the prize, the winner must confirm his/her ability to accept the prize in its entirety, including attending the chocolate appreciation evening on 25/05/2010. If the winner is unable to take the prize as stated, they will forfeit and another winner will be drawn – no compensation will be paid in lieu. The winner will also be announced in The Australian newspaper on 29/04/2010. The result of the prize draw is final and no correspondence will be entered into.
9. The first eligible entry drawn will win the Major Prize.

10. Prizes are not transferable or exchangeable or redeemable for cash or any other goods or services nor can they be re-sold. The Promoters accepts no responsibility for any variation in the value, performance, or availability of any prize. The Promoters reserve the right to substitute the advertised prize for a prize of equivalent or greater retail value if, for any reason beyond the Promoter’s control, the Promoters are not able to give the prize-winner the advertised prize, subject to State legislation. Any incidental costs relating to the prize are the responsibility of the winner.
11. All elements are subject to availability at time of booking.
12. Accommodation is based upon two adults sharing.
13. Unless expressly stated in these terms and conditions all other expenses become the responsibility of the winner. The winner (and their companions) are responsible for all expenses including but not limited to spending money (other than that specified), meals (other than that specified), drinks (other than that specified), incidentals, mini-bar, laundry, room service, telephone calls, activities, insurance, taxes (including departure taxes), energy surcharges, gratuities, services charges, passports, travel insurance and all other ancillary costs. A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges. The winner (and their companions) is also responsible for ensuring that they have suitable travel insurance for the travel period. Travel insurance is not included in the prize and will be the responsibility of the winner. Travel insurance is strongly recommended by the Promoter.
14. If applicable, flights leave from the winner’s nearest capital city. The winner and their travelling companions must travel on the same flight.
15. Flights and accommodation are subject to availability at the time of booking, are non-transferable and cannot be exchanged for travel to other destinations. If the winner and their travelling companions wish to extend their trip they will be able to do so at their own expense.
16. The Promoter reserves the right to redraw the prize in the event of an entrant failing to comply with these terms and conditions or forfeiting or not claiming the prize by 22/07/2010. If the prize remains unclaimed by that date, a second draw will be held at 12.00pm AEST on 12/08/2010 at the same location as the original draw. In the case of an expired event, the winner will forfeit that portion of the prize and no compensation will be paid in lieu. Disposal of any unclaimed prize may be made subject to any written directions given by any government authority and pursuant to any relevant legislation. Any unclaimed prize draw winner will be contacted by phone and mail immediately. Any winner will also be announced in The Australian newspaper on 19/08/2010.
17. The Promoter, other entities associated with this competition and their related bodies corporate, and each of their officers, employees and agents shall not be liable for and shall be held harmless in respect of any loss, damage, or injury whatsoever which is suffered (including but not limited to direct or consequential loss) or sustained, as a result of or arising from the winner’s acceptance and use of the prize, except to the extent that any such liability cannot be excluded by law.
18. Entry details remain the property of the Promoter. Acceptance of the prize is deemed to be acceptance by the winner of these terms and conditions and approval to use the winner’s name and photograph for publicity purposes, unless specifically requested by the winner not to do so at the time of accepting the prize.
19. If the competition does not run for its duration due to, but not limited to, computer viruses, tampering, unauthorized intervention, fraud, technical failures or any other cause beyond the Promoter’s control that corrupts or affects administration, security, fairness or proper conduct of the competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process. The Promoter will not be responsible for:
(a)Malfunction, delay or traffic congestion on any telephone network or line, computer on-line system, servers or providers, computer equipment, software, or website;
(b)Failure of any entry to be received by the Promoter as a result of those matters; nor
(c)Any injury or damage to entrants or any other person related to or resulting from participation in the competition or downloading any materials relating to the competition.
